Terms of Service

Welcome to GymRPG. These Terms of Service ("Terms") govern your access to and use of the GymRPG mobile application and related services (collectively, the "Service") operated by GymRPG ("we", "us", "our").

Please read these Terms carefully before using the Service. By downloading, installing, or using GymRPG, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account or using the Service in any manner, you acknowledge that you have read, understood, and agree to these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

You must be at least 13 years of age to use GymRPG. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of your parent or legal guardian, who must agree to these Terms on your behalf.

In the European Economic Area (EEA), you must be at least 16 years of age, or have verifiable parental consent.

By using the Service, you represent and warrant that you meet the applicable age requirements.

3. Accounts

3.1 Account Creation

To access most features of GymRPG, you must create an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3.2 Account Security

You agree to notify us immediately at support@gymrpg.app of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to maintain account security.

3.3 One Account Per Person

Each person may maintain only one GymRPG account. Creating multiple accounts to circumvent bans, gain unfair advantages, or exploit features is prohibited.

4. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the GymRPG app on a device you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer or attempt to extract the source code of the app
• Use the Service to build a competitive product or service
• Remove any copyright, trademark, or proprietary notices

5. User Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation
• Harass, threaten, or harm other users
• Post or transmit content that is offensive, hateful, sexually explicit, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with anyone
• Spam, phish, or send unsolicited communications
• Use bots, scripts, cheats, or automation tools to gain unfair advantages
• Exploit bugs or glitches; instead, report them to support@gymrpg.app
• Attempt to hack, disrupt, or gain unauthorized access to the Service or its systems
• Buy, sell, or trade accounts or virtual items outside of approved in-app mechanisms

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion, with or without notice.

6. Virtual Currency & Items

GymRPG includes virtual currencies ("Gems", "Gold/Coins") and virtual items (equipment, cosmetics, titles, pet items) that may be earned through gameplay or purchased via in-app purchases.

• Virtual currency and items have no real-world monetary value and cannot be redeemed for cash or any equivalent outside the app.
• You do not own virtual currency or items — you are granted a limited license to use them within the Service.
• Virtual currency and items are non-transferable and may not be sold, gifted, or traded outside of official in-game mechanics.
• We reserve the right to modify, adjust, or remove virtual currency and items at any time, including in the event of account termination or service discontinuation.
• We are not responsible for unauthorized acquisition of virtual currency through fraudulent means.

7. In-App Purchases

GymRPG offers optional in-app purchases of Gem packs and other premium content. All purchases are processed by Apple (App Store) or Google (Google Play) under their respective terms and conditions.

• All purchases are final and non-refundable, except where required by applicable law or the refund policies of Apple or Google.
• To request a refund, contact Apple or Google support directly as they handle all payment transactions.
• Prices are displayed in your local currency and may change at any time without notice.
• We are not responsible for any taxes or fees that may apply to your purchases.

8. GymRPG Pro Subscription

GymRPG offers an optional premium subscription ("GymRPG Pro") that provides access to additional features and content.

• Subscriptions are billed on a recurring basis (monthly or annual) through your App Store or Google Play account.
• Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• You may manage or cancel your subscription at any time through your device's account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.
• No refund is provided for unused portions of a subscription period.
• We reserve the right to change subscription pricing with reasonable prior notice. Continued use after a price change constitutes acceptance.

9. User-Generated Content

GymRPG allows users to create content such as usernames, bios, party names, and chat messages. By submitting content, you:

• Represent that you own or have the necessary rights to submit such content
• Grant us a worldwide, royalty-free license to use, display, and distribute your content within the Service
• Agree that your content does not violate these Terms or any applicable laws

We reserve the right to remove any content that violates these Terms or that we find objectionable, without notice.

10. Intellectual Property

The GymRPG Service, including its graphics, logos, designs, text, software, and all other content, is the exclusive property of GymRPG and its licensors, protected by intellectual property laws. You are granted no ownership rights in or to the Service.

"GymRPG" and associated logos are trademarks of GymRPG. You may not use these trademarks without prior written permission.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content in the Service, including nutrition data sourced from OpenFoodFacts.

Health Disclaimer: GymRPG is an entertainment and fitness tracking application. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional before starting any exercise or nutrition program. GymRPG accepts no liability for injuries, health conditions, or other harm resulting from use of the app.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GYMRPG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your transmissions or data
• Conduct of third parties in the Service
• Any other matter related to the Service

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim, or USD $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless GymRPG and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service immediately ceases. Sections 6, 10, 11, 12, 13, and 15 survive termination.

You may delete your account at any time within the app (Settings → Account → Delete Account) or by contacting support@gymrpg.app.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable law.

If you are located in the European Union, you may also have the right to submit complaints to your local data protection authority or use the EU Online Dispute Resolution platform.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page and, where appropriate, by sending an in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
